Terms
IMPORTANT: Before creating an account and using the Service, please read these Terms carefully. Creating an account or using functionalities that require acceptance of these Terms constitutes entering into an agreement for the provision of electronic services under the terms set out below.
§ 1. General Provisions
The Altitrip.com website, available at altitrip.com and in the form of a mobile application (hereinafter: the “Service”), is operated by Support Przemysław Otulakowski, with its registered office at: ul. św. Wojciecha 9 of/8, 59-220 Legnica, NIP: 6922428181 (hereinafter: the “Administrator”). These Terms set out the rules for using the Service, including the rights and obligations of Users and Visitors. The Service is of an informational, community-based and travel-related nature. The Service is not a tour operator, travel intermediary or seller of travel services, unless explicitly stated otherwise in separate information or an offer. Information published in the Service, including descriptions of places, reports, reviews, comments and advice, is of a general and informational nature. The Administrator does not guarantee its completeness, accuracy, timeliness, or suitability for the User’s individual decisions. Use of the Service is voluntary, provided that the use of certain functionalities may require creating an account. The Administrator may amend the Terms for important reasons, in particular in the event of: a change in the law, development or modification of the functionalities of the Service, a change in the organizational or technical model of the Service, the need to clarify the provisions of the Terms. The Administrator shall inform Users of any planned amendment to the Terms in advance by means of a notice in the Service and/or an e-mail sent to the account e-mail address, if the amendment concerns significant rights or obligations of the User. If the User does not accept the amended Terms, the User has the right to stop using the Service and delete their account. Continued use of the Service after the amendments enter into force constitutes acceptance of the amended Terms to the extent permitted by law.§ 2. Definitions
Service – an online platform available at altitrip.com and in the form of a mobile application. User – a natural person using the Service after creating an account. Visitor – a person browsing the Service without a registered account. Content – any materials posted by Users, in particular: descriptions of places, travel reports, comments, private messages, photos and videos, ratings and reviews. Following – a feature enabling Users to track the activity of other Users, places, regions and countries. Ad Targeting – displaying advertisements tailored to the User’s interests on the basis of their activity in the Service, to the extent provided for in the Privacy Policy and privacy settings, and in accordance with the consents granted, where required. Account – a set of resources and settings assigned to the User within the Service. Illegal Content – content contrary to applicable law, including in particular content infringing the rights of third parties, criminal law provisions, copyright, or personal rights.§ 3. Registration and User Account
Registration in the Service is voluntary and free of charge. The following are required for registration: providing a current e-mail address, creating a password, accepting the Terms and the Privacy Policy, being at least 16 years old or – in the case of a younger person – having the consent of a parent or legal guardian where such consent is required by law. The User undertakes to provide true, current and complete data required during registration. As a rule, one natural person may only have one account, unless the Administrator consents to more than one account. The User is obliged to keep their login credentials confidential and not disclose them to third parties. The Administrator may: verify accounts to the extent necessary to ensure security and the proper functioning of the Service, refuse registration or activation of an account in the event of a justified suspicion of a breach of law, these Terms, or a threat to the security of the Service, suspend or delete an account in the cases specified in these Terms. The Administrator shall not refuse registration arbitrarily; each decision may be justified in particular by the security of the Service, protection of other users, or the need to prevent abuse. The User may delete their account at any time by using the relevant function in the Service or by contacting the Administrator at: hello@altitrip.com.§ 4. Rules for Publishing Content
4.1. Permitted Content
The User may publish only content that is: created by the User or content for which the User has appropriate rights, permissions or licenses, compliant with Polish law, European Union law, and other applicable laws, related to travel, tourism, places, attractions, local culture, or topics connected with the profile of the Service, respectful, reliable and substantive, published in good faith.4.2. Strictly Prohibited Content
The User may not publish content that: incites hatred on the basis of race, ethnic origin, nationality, religion, sex, sexual orientation, disability, or other protected characteristics, promotes totalitarianism, Nazism, fascism, or other regimes and ideologies prohibited by law, encourages violence, self-harm or suicide, constitutes child pornography, pedophilic material, or any form of sexual exploitation of minors, promotes human trafficking, sexual exploitation or other serious crimes, encourages or supports terrorist activity, constitutes unlawful threats or incites the commission of a crime, promotes the unlawful use of drugs or psychoactive substances, is of a sextortion, blackmailing or extortionate nature.4.3. Other Prohibited Content
The User may not publish: advertisements, announcements and commercial offers without the Administrator’s consent, spam, chain messages, pyramid schemes and other mass or manipulative activities, content infringing copyright, related rights, image rights, or other rights of third parties, knowingly false information that may mislead other users, personal data of other persons without a legal basis or the required consent, links to dangerous websites, malicious software or phishing content, offensive, persistently vulgar, hateful content or content intended for harassment, trolling, astroturfing, or deliberately disrupting discussions, content completely unrelated to the profile of the Service, dangerous advice that may put health, life or property at risk or violate the law.4.4. Rules Regarding Photos and Reports
Photos, videos and other visual materials must be created by the User or published on the basis of appropriate rights or licenses. When publishing photos or videos containing the image of third parties, the User is responsible for having the required legal basis for their publication. Reports should concern authentic travel experiences or be clearly marked as editorial, promotional or inspired content. Copying content from other services without the relevant rights is prohibited.§ 5. Communication Between Users
The Service may enable Users to send private messages to each other. It is prohibited to use this function for: sending spam, harassment, intimidation or stalking, sending unsolicited erotic or sexual content, attempts to obtain data, money or benefits by deception, trading in goods or services prohibited by law. The User may block the ability to receive messages from specific persons, if the Service provides such a function. The Administrator may monitor metadata and respond to reports regarding private messages to the extent permitted by law and necessary for the security of the Service and the protection of other Users.§ 6. Following System
The User may follow: other User accounts, specific places, regions and countries. Following does not grant the right to: access private information, contact observed persons in violation of their privacy settings or against their will, use the data of observed persons for purposes contrary to law or these Terms. The User may stop following selected accounts, places, regions or countries at any time.§ 7. Advertisements and Targeting
The Service may display the Administrator’s own advertisements and advertisements of third parties. Advertisements may be tailored to the User’s activity in the Service, in particular on the basis of: followed content, added places, activity in the Service, declared interests, privacy settings and User consents, where required. The Administrator does not sell Users’ personal data to advertisers as a separate database. The Administrator may use advertising, analytics and measurement tools of external providers, in accordance with the Privacy Policy and the rules concerning cookies and similar technologies. The scope of ad targeting, the technologies used, and third parties involved are described in detail in the Privacy Policy and/or Cookie Policy. The User may manage privacy, cookie and advertising settings to the extent made available by the Service and through their browser or device settings.§ 8. Copyright and License to Content
The User retains copyright to the Content they publish in the Service, to the extent such rights belong to them. By publishing Content in the Service, the User grants the Administrator a non-exclusive, royalty-free, worldwide license to use such Content to the extent necessary for: maintaining, hosting, storing and technically processing the Content, publicly displaying, making available and distributing the Content within the functioning of the Service and the application, creating backup copies, technical versions, thumbnails and formats adapted to different devices, promoting the Service by presenting the User’s publicly available Content in the Administrator’s promotional materials, including on social media, in newsletters and informational materials, unless the User deletes the Content or raises a justified objection in this respect. The license referred to above is granted for the period during which the Content is published in the Service, and with regard to technical copies, archival copies, backups and promotional materials prepared in accordance with the law – also after the deletion of the Content for the period necessary to pursue the Administrator’s legitimate purposes, defend claims, or perform legal obligations. The User represents that the publication of the Content does not infringe the rights of third parties. Copying Content from the Service without the consent of its author or another legal basis is prohibited. The Administrator may remove or restrict access to Content that infringes the law, the rights of third parties, or these Terms.§ 9. Reporting Violations and Illegal Content
Any person may report to the Administrator Content that they consider illegal, infringing the rights of third parties, or contrary to these Terms. Reports may be submitted to: hello@altitrip.com or by means of a reporting form, if available in the Service. To the extent possible, a report should include: the reporting person’s details or a contact address for feedback, an indication of the Content concerned by the report, the URL address or other data enabling identification of the Content, justification of the report, if necessary, documents or information confirming the infringement. The Administrator shall review reports in a timely manner, with due diligence and proportionately to the nature of the case. If action is taken in relation to the reported Content, the Administrator may inform: the reporting person – about the outcome of the report, if they provided contact details, the User who published the Content – about the restriction of visibility, removal of the Content, a block or another measure, unless the law or the security of the proceedings justifies the absence of such information. The Administrator may preserve Content and data related to the report for the purposes of investigations, pursuing claims or performing legal obligations.§ 10. Liability
10.1. User Liability
The User is responsible for the Content they publish and for the manner in which they use the Service. The User undertakes to remedy any damage caused to the Administrator or third parties as a result of a culpable breach of law, these Terms, or the rights of third parties.10.2. Administrator’s Liability
The Administrator shall not be liable for Content published by Users, unless such liability arises from mandatory provisions of law. The Administrator shall not be liable for: actions of Users taken outside the Service, travel, purchasing, organizational or safety decisions made by Users on the basis of Content posted in the Service, temporary unavailability of the Service resulting from technical work, failures, force majeure or events beyond the Administrator’s control, lack of timeliness, completeness or usefulness of Content published by Users. The Administrator exercises due care to ensure that the Service operates properly, safely and as continuously as possible, but does not guarantee its complete uninterrupted availability. No provision of these Terms excludes or limits the Administrator’s liability towards a consumer or a person benefiting from consumer protection to the extent that such exclusion or limitation would be impermissible under mandatory provisions of law.§ 11. Moderation Measures, Penalties and Blocks
11.1. Types of Measures
In the event of a breach of these Terms, the Administrator may apply, proportionately to the seriousness of the breach: a warning, restriction of the visibility of specific Content, removal of Content, a temporary block of the account or selected functionalities for a period from 24 hours to 30 days, a permanent account block, account deletion.11.2. Grounds for Applying Measures
A measure may be applied in particular for: publishing prohibited Content, harassing other Users, creating multiple accounts in order to circumvent the rules of the Service, manipulating ratings, reviews or statistics, acting to the detriment of the Service, other Users or third parties, infringing copyright or other rights of third parties, attempts to circumvent a block, providing false registration data, where this is materially relevant to security or the lawful operation of the Service.11.3. Procedure and Appeals
The Administrator may apply a measure without prior warning if required by the security of the Service, the protection of other Users, the nature of the breach, or a legal obligation. The Administrator may inform the User by e-mail and/or through a notice in the Service about the measure applied, indicating at least the type of action and its basis, unless this would be inadmissible or purposeless due to security, an investigation, or applicable law. The User has the right to appeal a decision regarding the removal of Content, a temporary block, a permanent block, or account deletion by sending a message to: hello@altitrip.com. The appeal should contain data allowing the account or Content to be identified and the justification for the User’s position. The Administrator shall review the appeal within a reasonable time, taking into account the nature of the case and the risk to other Users. The submission of an appeal does not suspend the enforcement of the measure, unless the Administrator decides otherwise.§ 12. Account Deletion and Consequences of Deletion
The User may delete their account at any time. Deletion of the account shall, as a rule, result in termination of the provision of electronic services related to the account. After the account is deleted, the Administrator may: delete account data and Content assigned exclusively to that account, retain some Content in the Service in anonymized form, if justified by the integrity of discussions, the functioning of the Service, the rights of other Users, or legal obligations, store certain data after account deletion for the period necessary to perform legal obligations, handle complaints, pursue or defend claims, and ensure the security of the Service. Detailed rules regarding the storage of data after account deletion are set out in the Privacy Policy.§ 13. Personal Data Protection
Detailed rules regarding the processing of personal data are set out in the Privacy Policy available at: [LINK TO THE PRIVACY POLICY]. For matters related to personal data protection, contact may be made via: hello@altitrip.com. The User has the rights provided for in applicable law, in particular: the right of access to data, the right to rectification of data, the right to erasure of data, the right to restriction of processing, the right to data portability, the right to object to processing, the right to withdraw consent – where processing is based on consent, without affecting the lawfulness of processing carried out before its withdrawal. The User also has the right to lodge a complaint with the President of the Personal Data Protection Office.§ 14. Complaints
Complaints regarding the functioning of the Service may be submitted to: hello@altitrip.com. A complaint should contain: the User’s details or a contact address, a description of the problem, the date or approximate period of occurrence of the problem, where possible, additional information allowing the matter to be identified. The Administrator shall review complaints within 14 days, unless the nature of the case justifies the need for a longer period; in such a case, the Administrator shall inform the User of the expected response time.§ 15. Final Provisions
These Terms enter into force on 27 January 2026. In matters not regulated by these Terms, the provisions of Polish law and the applicable provisions of European Union law shall apply. Any disputes between the Administrator and the User shall be resolved by the competent common courts in accordance with the applicable law. This provision does not exclude the rights of a consumer or a person benefiting from consumer protection arising from mandatory provisions of law.
